MINIMUM WAGE RATE WEST VIRGINIA: $7.25

West Virginia adopts the federal minimum wage rate by reference. Any changes of the federal minimum wage will automatically affect the minimum wage of West Virginia.

Minimum Wage Tipped Workers

Cash Wage: $5.80
Maximum Tip Credit: $1.45

NOTE: Companies that fall under the jurisdiction of the federal Fair Labor Standards Act for minimum wage coverage may pay the federal tip credit of $2.13 per hour - see below.

Note:The cash wage or basic wage rate is the minimum required employer contribution towards your hourly minimum wage. The "maximum tip credit" - 20% for West-Virginia - is the amount of tips you will need on top of your cash wage to make the minimum wage of $7.25 per hour. If you do not receive sufficient tips in your workweek to achieve the minimum wage for all hours worked that week, your employer must make up the difference.

Minimum Wage Trainees, Internship

Minimum Trainee Wage: $5.15 per hour

West Virginia Minimum Wage is applicable to:
  • workers employed by the State of West of Virginia, it's agencies and departments.
    Or if you work for:
  • a company that doesn't gross over $500,000.00 annual;
  • an employer who employs during any calender week 6 or more employees at one separate, distinct and permanent location and has;
  • less than 80% of the workers engaged in any type of "individual" interstate commerce activity, such as:
    • processing, accepting or otherwise handling credit card transactions;
    • supplies (via telephone, fax, or email) or receiving goods shipped
    • across state lines;
    • driving a motor vehicle across states lines or on a federal highway;
    • keeping records of interstate transactions (such as invoices, payables, etc);
    • conducting company business via phone, email, regular mail or fax across state lines. 
Some industries are automatically covered under federal law

and are therefore exempt from the West Virginia minimum wage regardless of specific employee activities.

Overtime Pay West Virginia
Overtime pay is the cash compensation for the hours eligible employees work in excess of 40 hours in a workweek (a workweek = 7x24= 168 hours). The overtime pay rate is one and one-half (1.5) times the regular working hour rate of pay.
